You cannot publish other people's copyrighted images in blog posts, Powerpoint presentations, or ANYWHERE!

Mary is 100% correct … Use of a copyrighted image without consent of the owner is violation of copyright law. We have a mutual friend (a national speaker) who received a letter from an attorney after using a photo snatched from a Google image search. This speaker was happy to settle for a cash demand of some $800 to avoid being sued.

Using Google images to find blog graphics and republishing those images on a real estate blog puts the agent AND BROKERAGE at risk of being sued!

Use iStock or another commercial source for images. I pay $1 – $5 for most images on my blog for the photos I do not take myself.

I am sorry, but MOST of the time when bloggers and others use photos without permission it is copyright infringement. Let me quote from another source, perhaps this will help:

“Images are subject to the same copyright and fair use laws as written materials, so here too you'll want to think about the fair use factors that might apply. Is the image used in a transformative way? Are you taking only what's necessary to convey your point? A thumbnail (reduced-size) image, or a portion of a larger image is more likely to be fair use than taking an entire full-size image. If you want to go beyond fair use, look for Creative Commons licensed images.” Please see http://www.eff.org/issues/bloggers/legal/liabil… Most bloggers are using the full photo, not a tiny thumbnail sized image, and therefore it is not covered under “fair use”. You do not have to be an attorney to know the basic guideline around the use of images found online: ASK before taking and using.

Again, it depends upon the purpose / use of image and context of the blog –always a good thing to check with your attorney before using…

You should not just search for photos online and then use them in your blogging. Images, like text, are protected by copyright. (They don't have to be marked with a copyright symbol for that to be the case.) Please encouage people to be responsible in how they use images in their blogs and marketing.

I'm not an Intellectual Property rights attorney, but I believe it totally depends upon your use. For example, I'm pretty sure you couldn't use any copyrighted content for promotional purposes. However, I'm not sure about using them (images) in informational (i.e. non-promotional) blog posts.
